Online Mediation or In-Person: Determining the Best Path for your Case

This month’s blog post is my recent article, published on the OBA’s ADR Section website on August 27, 2021. In it, I discuss the top 5 things to consider when deciding to mediate online or in-person.

Mediation Tip of the Month

It’s important to set the tone for the mediation before it begins. Keep this in mind when preparing your mediation memo.

When preparing your briefs, keep in mind that the opposing client(s) is your audience. Address both the strengths and challenges. Be mindful of the tone of your memo and make sure it is consistent with your objectives for the mediation.
