Opening Statements can be very useful when setting the tone for your mediation, as well as conveying your message to the opposing side. Some things to keep in mind:

  • Be clear, organized, and methodical
  • Key talking points should be referenced by documentation
  • Focus on persuading the other side of the risks, and why they should move toward your settlement zone
  • Encourage your client to speak, if you feel it will be helpful
